£18bn car finance payout – are you due a cut?, Sky TV £13/mth, free £25 on 0% card, Martin's 3 mortgage blockers, Lidl baked freebies

There's been much confusion about car finance in the past few days. On Friday, after the Supreme Court ruling, you probably saw or read headlines of MILLIONS TO MISS OUT ON COMPENSATION. Then on Sunday, after the regulator's announcement, it was MILLIONS TO GET COMPENSATION. So let me decode it for you, I'll explain...

- What is this all about?
- Should I put in a complaint now?
- I've already complained, what should I do?
- How much will people get?
- Final key need-to-knows.

Much of the confusion stems from the fact the Supreme Court wasn't dealing with the type of car finance most people have put complaints in about...

Strand 1: Discretionary Commission Arrangements (DCAs)... if you've heard me talk car finance, it'll have been about this. In January 2024, the regulator, the Financial Conduct Authority (FCA), launched an investigation into DCAs by car finance firms, with a view that there was a likelihood of systemic potential mis-selling.

This WASN'T what the Supreme Court cases covered, but even so, the DCA route was put on hold in case owt came up in court that affected it. Nowt substantial did. So on Sunday, the regulator rekindled this by announcing a consultation into a mass redress scheme.

- What is a DCA? It's where the interest rate you were charged was variable, so it could be increased in order for the broker or dealer to get more commission, hence discretionary commission. DCAs were banned in Jan 2021, but if you got Hire Purchase or Personal Contract Purchase (PCP) car finance before then, around half had a DCA in place. If yours did, and you weren't informed (& almost no one was), the regulator thinks you may've been mis-sold and could be due £100s back.

- How do I know if I had a DCA? You usually don't. So to find out, you need to put in a complaint to the car finance firm to ask it.

- What happens next? The consultation on how a mass redress scheme will work will launch by October and should last six weeks. Assuming it goes through, which it almost certainly will (it's more likely specifics that'll be contested), people will begin to be paid at some point in 2026.

How soon in 2026 depends on the type of scheme the FCA comes up with. If it does an automatic payout system, where people don't need to do anything, that'll take longer; if it does an 'opt in' system, that'd be quicker. See should I complain now? below.
Strand 2: The Supreme Court cases. In October 2024, the Court of Appeal shocked everyone (regulators, commentators, the Government, industry and me too) by upholding three legal cases brought by claims management companies. These were focusing on whether hidden commission was unlawful, whether it was fixed or discretionary.

The first two, in over-simplified terms, said that car brokers had a duty to act in their customers' best interests & impartially, so all undisclosed commissions were a bribe, and therefore almost every car finance agreement was unlawful. On Friday, the Supreme Court overruled the Court of Appeal, and these two cases were struck down, so are no longer relevant.

The third case, let's call it the 'unfair commission' case, was upheld, so similar cases are likely to be part of the regulator's consultation. The specifics in the case were that over 55% of the cost of credit was paid to the car dealer as a commission. The Supreme Court said that this huge proportion, combined with the fact the dealer's brochure made it look like it'd worked with a panel of finance firms, which in practice it hadn't, made it unfair.

The court then said 'unfair commission' was complex, so it would need deciding on a case-by-case basis. It suggested other relevant factors to be taken into account, as well as the proportion and type of commission and the disclosure, including whether lenders complied with rules and the nature of the customer (eg, vulnerable customers).

- What do I do if I think my situation was 'unfair commission'? That's a toughie. While we've a pretty clear idea with regards to DCA cases, 'unfair commission cases' are new. I'm hoping this will all be clarified by and included in the regulator's easy-to-do mass redress scheme.

Yet the challenge for the regulator is codifying exactly what counts as unfairness and what data will be available to prove it. So I doubt we'll have much idea until later this year. For most people, for now my best guess is you should wait and see (more options in my final key points below).

If you've already put a complaint in, skip below. If not, then let's start with the official advice:

The regulator, the FCA, says...

"Our advice remains that consumers concerned that they were not told about commission and who think they may have paid too much for the finance, should complain now." [You can do that for free via our MSE car finance complaint tool.]

"We aim to make any scheme easy to participate in, without needing to use a claims management company (CMC) or law firm. Using a CMC or law firm may end up costing them up to 30% in fees of any compensation they receive. "

The FCA is strongly warning against using claims firms because the mass redress scheme it's looking at will likely involve lenders being made to contact you, then either automatically paying out (if you've an eligible claim) or asking if you want to opt in for your claim to be considered. So sign up to a claims firm now and you may have to pay it, even if it ends up doing nothing.

In recent weeks, I had been saying 'do nothing' as there was so much uncertainty. Now we're on a firmer base on the back of what the regulator says, my view is there's no harm in putting in a DIY complaint to see if you had a DCA. You can use our free complaint tool to do that.

My (again) guess is this may be particularly beneficial in old cases where you have the details of your car finance, but the car finance firm may have deleted it - as this way, you put a marker in that you want your case looked at.

In newer cases, complaining now is more about the fact many want to know if they had a DCA and whether they may be due compensation or not. So if you don't want the hassle, you likely wouldn't lose out by not putting one in at this point, you could just wait.

You don't need to submit another complaint. If you used our DCA complaint tool, one of three things likely happened:

You were told you had a DCA. If the firm said you did have a DCA in its reply, then it's logged, all is done. Now you just need to wait, but you are potentially due some compensation.

In terms of time limits, the firm's response probably stated claims were on pause until 4 Dec 2025. Yet as the Supreme Court case has delayed everything, the regulator will almost certainly extend this, with complaints now likely to be dealt with under the new redress scheme from 2026.
You were told you didn't have a DCA. If the firm said you didn't have a DCA, then it's likely over, unless your claim comes under the more narrow 'unfair commission' route I mentioned earlier. Yet exact definitions may change or force firms to double-check. Still, for now, you've done all you need to.
You got a poor response. If it didn't say anything other than to acknowledge your complaint, that's frustrating but there's nothing else to do for now, as it is logged for complaint purposes, and should be part of a future redress scheme if you're eligible.

If you signed up to a claims firm to do this...

I've had lots of questions about this via social media, many asking me if they can they get out of it or will they have to give the firm a cut?

We know very little about this right now. My guess is, if it has done work for you, you'll likely have to give it a cut, even if it was unnecessary to use it. If not, that's something we'll be pushing the FCA - which regulates some claims firms (and the Solicitors Regulation Authority, which regulates the rest) - to clarify within the consultation, especially any firms that used misleading sign-up claims.

The likelihood though for most is that it's based on the contract you signed, many of which include 'cancellation fees' if you try to get out of it early (worth checking so you know the score).

The regulator has said it expects the total cost of the redress scheme to be somewhere between £9 billion and £18 billion, including costs, with the most likely outcome somewhere in the middle.

We only know about the DCA element so far - there are thought to have been 14 million DCA car finance deals between 2007 and January 2021. Each deal is separate, so if you had more than one, you could be due money for each of them. The regulator estimates that most people will get less than £950 per agreement. So I'd see this as high hundreds but not thousands of pounds.

How might it work?

In the past with DCA cases, the ombudsman awarded people the difference between the actual interest their car finance was increased to and the lowest rate available at the time.

The consultation will look at the amounts people are due, but it's thought the regulator may not give as much as the ombudsman did (eg, as a made-up example, it could say you'd get the difference between what you were charged and a reasonable amount of interest).

Not everyone with a DCA will get redress though. Those who were charged 0% interest won't, and there will be cases where even though you were charged interest, it wasn't overly hiked (or you were told about the DCA), so you will get little or nothing.

Interest will likely be added on top of your refund, potentially back to the point that you got the agreement, though this will be confirmed by the redress scheme. The Supreme Court indicated this should be at commercial rates. The regulator's current suggestion is it's likely to be roughly 'UK base rate for each year + 1%', which is typically 3% a year simple (ie, non-compounded) interest.

I could try and find a nice easy title to wrap all these into one, but the truth is, it's the other key stuff that didn't fit into the sections above...

How far back can complaints go? This is likely to be a fight. The regulator argues it should go back to 2007, which is when the ombudsman can go back to. The car finance trade body has come out hard against that, saying it should only go back to 2014, when car finance came under regulation, especially as finding details as far back as 2007 may prove impossible.

MSE & I will be arguing for 2007 in our consultation response. As if not, it could break the whole redress system and see us having to suggest people going en masse via the ombudsman or courts instead, clogging them up. What we need now is the regulator to be able to deliver an easy, consistent, speedy process.
How much paperwork will I need to prove this? This is one of the prime stumbling blocks. It's best practice for firms to keep your paperwork for six to seven years after the finance was active (that's the point when the agreement ended for most). They can then destroy the information after that, and indeed that's generally seen as good data protection practice.

So if you don't have the paperwork and it's a recent case (say roughly the last decade or so), you're likely fine. If it's older, then if you have your paperwork, great. Even if you only have partial details of the firm and car, that would help (see what info do I need?) as the redress scheme may be able to look at the patterns used by individual firms (similar was done with PPI).

If not, it gets much trickier, and we'll be pushing for the consultation to consider what the options are.
None of this is certain and the regulator may be subject to legal challenge. While I think there's a high likelihood of payouts from 2026, the industry could fight this and even take the regulator to a judicial review over elements of its proposal.

I believe it'd be best for consumers and the industry to have clarity, consistency and transparency, to get on with this and get past it. The industry is already far less financially exposed than it could've been had the Supreme Court followed the Court of Appeal ruling - so much so, many car finance firms' share prices jumped on Monday morning, even after the regulator's consultation announcement.
Our approach is always the simple, easy route, not court, but that doesn't mean you can't do that. This isn't my first mass reclaim rodeo; I was involved in bank charges reclaiming and PPI. I learnt through those that the enormous majority of MSE users want it to be as easy and simple as possible. So we focus on the mass reclaim routes, and all the info above is based on that.

Yet you can go harder if you know what you're doing. There is nothing stopping you going to court, either by yourself if you feel comfortable, or with legal representation. In some circumstances, you may end up with more compensation than the mass route (though legal fees may eat away at that gain), but that's not something we can specifically help you with. The choice is yours.

This is probably most relevant for the more complex 'unfair commission' cases. Some may want to put a complaint in now and go to the ombudsman or court. Personally, I'd wait until we know what the redress scheme will include, but it's up to you.

Option 2. It's also a TOP 0% spending deal, so if you need to borrow, you can't do it cheaper. The table shows how it compares with other top 0% deals - note that some are 'up to' cards, so some get a backup rate that's worse than the headline rate. Our eligibility calc tells you about this.

Important: Even though spending on these cards is interest-free, unless you're stoozing, only borrow if you NEED to and only for a planned, affordable one-off purchase - not to fill gaps in your income. If in doubt, don't borrow.

If you do borrow on these cards, make sure you follow the Golden Rules...
a) Pay at least the monthly minimum and stick within your credit limit, or you can lose the 0% and get hit with fees.
b) Plan to clear the card (or balance-transfer) before the 0% ends, or these cards charge 24.9% rep APR interest.
c) Don't use these cards to withdraw cash - it's not at 0%.
Will applying affect my ability to access credit? Any full application leaves a mark on your credit file, even if you're rejected (hence why we say to use our eligibility calculator first). Lots of applications in a short time can have a small, negative impact. Yet for most with decent credit histories, applying for one card shouldn't be a problem. However, it's best avoided if you've an important credit application (eg, a mortgage or balance transfer) to do within the next few months. Unlike for us humans, there's no NHS for pets, so without cover a trip to the vet can leave you footing a huge bill. Treatment prices have soared in recent years, and though the Competition and Markets Authority is investigating, it's just pushed back the deadline to publish its findings to next May, so don't expect any quick fixes. In the meantime, our Cheap pet insurance guide has the full info on how to cut the cost of insurance, but in brief...

CATS & DOGS. Prices are bespoke, so the key's to get as many quotes as possible in the shortest time...

1. Combine comparison sites. Try as many as you've time for, as they search different insurers and sometimes have different prices, and most let you get multi-pet quotes. In order of how many insurers they compare, try MoneySupermarket* | Compare The Market* (single pet quotes only) | Confused.com* | Gocompare.

2. Check deals not on comparison sites. Big providers Petplan* and Direct Line don't appear on comparisons for pet insurance, plus there are promo deals that comparisons don't list (some as we've blagged exclusive extras). So check them and compare with the comparison site winners (though we've limited feedback on these):

- Ends Thu. Waggel* via this link offers a £55 Amazon voucher per cat or dog insured, paid after 90 days of cover.

3. Cats are seen as free spirits, dogs aren't. So you're liable for your dog if it causes damage or injury to other people or property. Always check your insurance offers third-party cover (as a minimum, get it standalone from Dogs Trust).
HORSES, RABBITS, PARROTS, REPTILES & OTHER PETS. As comparison sites don't usually work for these, you'll need to manually compare quotes directly with specialist insurers.
- For horses and ponies: Try SEIB, Petplan Equine and NFU Mutual.
- For rabbits, budgies, guinea pigs, parrots, lizards and more: Try Exotic Direct* and British Pet Insurance (+ Sainsbury's and Petplan* for rabbits).
Warning: Beware switching provider if your pet has an existing condition. Most new policies won't cover past issues, whether you've claimed for them or not. But stay with your old insurer and you're likely to pay more to cover that condition in future. So it's usually a hard choice between switching to a cheaper policy with no cover for that specific condition, or sticking and likely paying more. Full help in existing problems.
Pet insurance NEED-TO-KNOWS...
1. It generally covers big issues (such as broken bones and tumours), not check-ups. See what's covered.
2. Need cover but can't afford it? If you're on certain benefits, charities such as the PDSA may help with vet bills.
3. Could you self-insure? For smaller animals, you could put cash in savings to cover fees. See self-insuring help.
4. Keep your pet's routine jabs up to date. Or it may invalidate your insurance.
5. Always check the policy is right for you. It's not easy, as insurance is about protection from the unknown, but do check the policy details, what's excluded, and that the firm's regulated by the Financial Conduct Authority.
6. If your claim's unfairly rejected, take the firm to the Financial Ombudsman. Once you've complained to your provider, you've then a right to go to the free, independent Financial Ombudsman Service for its help to settle the claim.
